Trump Declares Biden’s Autopen Pardons ‘Null And Void’

President Donald Trump declared on Monday that he was revoking all last-minute pardons issued by former President Joe Biden through the use of an autopen, a move certain to spark outrage among Democrats and potentially lead to new legal challenges.
“The ‘Pardons’ that Sleepy Joe Biden gave to the Unselect Committee of Political Thugs, and many others, are hereby declared VOID, VACANT, AND OF NO FURTHER FORCE OR EFFECT, because of the fact that they were done by Autopen,” Trump announced in an early morning post on his Truth Social platform.
“In other words, Joe Biden did not sign them but, more importantly, he did not know anything about them!” he continued, referring to the 82-year-old former president amid ongoing concerns about his cognitive abilities.
Trump further claimed that Biden had not personally approved the pardons.
“The necessary Pardoning Documents were not explained to, or approved by, Biden,” he asserted. “He knew nothing about them, and the people that did may have committed a crime.”
Additionally, Trump issued a warning that individuals from the former January 6 House select committee who had been pardoned by Biden would now face scrutiny.

“Is the auto pen allowed for pardons? No. It is not constitutionally allowed for presidential pardons. Why? Because the U.S constitution requires the president to be present. He was in a different state on vacation”

“Therefore, those on the Unselect Committee, who destroyed and deleted ALL evidence obtained during their two-year Witch Hunt of me, and many other innocent people, should fully understand that they are subject to investigation at the highest level,” Trump stated.
“The fact is, they were probably responsible for the Documents that were signed on their behalf without the knowledge or consent of the Worst President in the History of our Country, Crooked Joe Biden!” he added.
On Biden’s final day in office, he issued a wave of last-minute pardons, including preemptive pardons for all nine members of the January 6th Committee. Among them were the committee’s leaders, Rep. Bennie Thompson (D-Miss.) and former Rep. Liz Cheney (R-Wyo.), who later endorsed Vice President Kamala Harris in the 2025 election, as reported by the New York Post.
Other notable figures granted pardons included former Chairman of the Joint Chiefs of Staff General Mark Milley and Dr. Anthony Fauci. Milley, who had publicly criticized Trump as a “wannabe dictator,” played a key role in testifying before the House panel investigating the January 6th Capitol riot.
Fauci, who was President Biden’s chief medical advisor until his 2022 retirement, came under fire for dismissing the theory that COVID-19 originated in a Chinese lab. Trump and many Republicans have accused Fauci of misleading Congress regarding the U.S. government’s involvement in gain-of-function research.
While testifying before Congress, Fauci denied that the National Institute of Allergy and Infectious Diseases (NIAID), under his leadership, had provided U.S. funding to EcoHealth Alliance for gain-of-function research.
However, federal oversight agencies and congressional investigations later revealed evidence indicating that federal funds had, in fact, been directed toward such research at the Wuhan Institute of Virology in China, according to The Post.
Trump strongly condemned Biden’s pardons, calling them “disgraceful” and stating, “Many are guilty of MAJOR CRIMES!”
It remains unclear whether any court will intervene to overturn Biden’s pardons based on the autopen issue or if anyone will formally contest Trump’s declaration of their invalidity—particularly if he directs his Justice Department to pursue the matter.
Recently, Missouri Attorney General Andrew Bailey raised concerns over multiple executive orders issued by Biden bearing identical autopen signatures. Bailey suggested that if these reports were accurate, “these executive orders, pardons, and all other actions are unconstitutional and legally void.”
“I am demanding the DOJ investigate whether President Biden’s cognitive decline allowed unelected staff to push through radical policy without his knowing approval,” Bailey stated.
