Appeals Court Denies Trump’s Attempt To Overturn E. Jean Carroll Ruling

In another blatant example of lawfare targeting President Donald J. Trump, the Second Circuit Court of Appeals on Friday declined to overturn a controversial lower court ruling in the defamation and sexual abuse case brought by far-left activist and former Elle columnist E. Jean Carroll.

The decision came from the full 11-judge panel of the Second Circuit sitting en banc. It upheld a prior 3-judge decision enforcing a $5 million civil jury award from May 2023 — a case many legal analysts say was tainted from the start by inflammatory and prejudicial evidence.

President Trump had sought a new trial, arguing that the original judge improperly allowed jurors to view the infamous Access Hollywood tape and unrelated claims from two other women — allegations he has repeatedly and unequivocally denied.

Even two of Trump’s own judicial appointees, Judges Steven Menashi and Michael Park, dissented from the ruling. They blasted the court’s decision to admit what they called “propensity” evidence — material used to paint Trump as guilty by association rather than by facts of the case.

“This was a pile-on of unrelated, unverified, decades-old accusations, none of which had anything to do with the claims at hand,” Trump’s legal team argued. “No fair trial allows that.”

The original case, which stemmed from Carroll’s decades-old and unproven claim that Trump assaulted her in a Manhattan department store dressing room in the 1990s, lacked basic evidentiary standards — no date, no police report, no forensic evidence. In fact, even the jury rejected her claim of rape, yet still awarded damages over defamation based on Trump denying her story.

Now, Carroll — who has spent years capitalizing on the case to sell books and appear on cable news — is eyeing yet another lawsuit, this time over a Truth Social post from Trump on Memorial Day, where he torched the politically motivated trials against him.

“Happy Memorial Day to All, including the Human Scum that is working so hard to destroy our Once Great Country…” Trump posted. He pointed out that Carroll failed to produce the infamous dress, never filed a police report, and originally praised him on CNN before doing a sudden reversal — raising serious credibility questions.

Despite the fact that Trump never received a criminal conviction in the matter — and that the civil trials themselves were riddled with bias and overseen by overtly anti-Trump judges — Carroll's attorney Roberta Kaplan told Newsweek that “all options are on the table” for another round in court.

Trump is also appealing a separate $83.3 million jury award tied to other Carroll-related defamation claims, and has argued that the Supreme Court’s recent ruling affirming presidential immunity should shield him from civil liability as well — particularly for statements made while in office.

President Trump has maintained from day one that he never met Carroll, aside from a brief handshake at a public event decades ago, and has accused her and her legal team of waging a coordinated political attack.

“She didn’t know when the so-called event took place – sometime in the 1990s – never filed a police report, didn’t have to produce the ‘dress’ that she threatened me with (it showed negative!)…” Trump wrote in the now-viral post. “The rape charge was dropped by a jury!”

At this point, Carroll’s legal team seems less interested in justice and more obsessed with staying relevant — or making sure President Trump is distracted and drained as he prepares for another term in the White House.

This case, like so many others, shows the true nature of the two-tiered justice system in America today — where activists in robes and corporate media allies work hand in hand to smear, silence, and sabotage the one man fighting to give the country back to its people.
