Justice Clarence Thomas, in a fiery concurring opinion, made the stakes crystal clear: “For good reason, the Court today puts an end to the ‘increasingly common’ practice of federal courts issuing universal injunctions.”
For those who understand the architecture of American liberty, this decision is nothing short of historic.
As someone who has dedicated a career to studying and teaching the history of the American Founding, I can say without hesitation: this ruling may very well have saved the Constitution.
Thomas wasn’t finished. He added that the Court’s decision confirms a crucial truth: federal courts do not have limitless power. In fact, he declared that this decision "provides a ceiling on federal courts’ authority.”
Inject that straight into the bloodstream of constitutional governance.
“Lower courts should carefully heed this Court’s guidance and cabin their grants of injunctive relief in light of historical equitable limits,” Thomas warned. “If they cannot do so, this Court will continue to be ‘dutybound’ to intervene.”
The Founders built a system that restrained rulers and honored the rule of law. Over two centuries later, men like Thomas continue to honor that vision. It is a remarkable — even miraculous — thing.
June 27, 2025 should now be remembered as a day of constitutional salvation — when the republic was rescued from the brink by the very branch that had been manipulated to threaten it.
Thomas’s courage was expected. But what made the ruling even more extraordinary was the fact that the entire conservative majority on the Court stood united, writing with clarity and conviction.
Justice Amy Coney Barrett, authoring the majority opinion, delivered a stinging rebuttal to Justice Ketanji Brown Jackson, who dismissed the issue as a “mind-numbingly technical query.”
Barrett did not hold back: “We will not dwell on JUSTICE JACKSON’s argument, which is at odds with more than two centuries’ worth of precedent, not to mention the Constitution itself. We observe only this: JUSTICE JACKSON decries an imperial Executive while embracing an imperial Judiciary.”
Those words will live on as some of the most powerful ever written by a Justice — and certainly among Barrett’s finest.
There was a time when many Trump supporters grew frustrated by what seemed like a lack of resolve in the courts, especially as federal judges wielded universal injunctions like political weapons, blocking policies at will, often based on little more than partisan rage.
Let’s be clear: these rulings were not merely judicial oversteps. They represented a direct assault on the principle of self-government. Had they been allowed to stand, the outcome of elections would have become irrelevant — reversed by any activist judge eager to do the Left’s bidding.
And yes, many conservatives, myself included, questioned whether relying on the judicial system to restrain itself was wise. Some even called on the Trump administration to assert its co-equal powers by simply refusing to comply with clearly illegitimate rulings.
But now, thanks to this week’s Supreme Court ruling, that desperate moment of uncertainty has been replaced by vindication.
