Feds Probe AOC For Employing Illegal Alien, Helping Migrants Evade ICE
The Trump administration has opened a federal investigation into Rep. Alexandria Ocasio-Cortez (D-NY) over explosive allegations that she employed an illegal immigrant on her congressional staff and assisted others in evading federal immigration authorities.
Tom Homan, the former acting ICE director now serving as Border Czar under President Donald J. Trump, confirmed Monday that the probe is officially underway. Speaking on The Benny Johnson Show, Homan revealed that Immigration and Customs Enforcement has been instructed to drill down into the claims.
“It’s being looked at… I’m aware of it, we’ve asked ICE to drill in on that case,” Homan said. “As far as her educating people how to evade ICE arrests, she’s really educating them on how to avoid prosecution. Because there are statutes on the books—when you knowingly hinder your removal, that’s a crime.”

View PlansThe allegations center around Diego de la Vega, an undocumented immigrant who served as Deputy Communications Director in AOC’s office after years of left-wing political activism in New York. De la Vega, who once interned for Rep. Carolyn Maloney (D-NY) and held a staff role with former Harlem Assemblyman Robert J. Rodriguez, fled the country in March amid stepped-up deportation efforts by the Trump administration.
According to TownHall.com, de la Vega had been appointed by AOC despite lacking legal status. She even praised him in a past interview, declaring, “Diego is amazing.”
Legal experts have raised red flags over how a non-citizen not authorized to work in the U.S. was able to land a senior position in a congressional office—potentially with access to sensitive information. Homan made clear that, if substantiated, this amounts to a federal crime.
Meanwhile, Ocasio-Cortez is also facing scrutiny for organizing webinars and events that trained illegal immigrants on how to dodge ICE agents. The events, held in both English and Spanish, provided “Know Your Rights” packets, told participants they “do not have to open the door” for federal agents, and offered assistance in signing privacy release forms—documents that would allow AOC’s office to directly intervene in deportation proceedings.
In February, Homan sent a formal request to the Deputy Attorney General urging a criminal investigation. Ocasio-Cortez has since confirmed that she requested clarification from the DOJ and received no response.
Speaking to Fox News last month, she lashed out at the Trump administration, calling the inquiry “politically motivated” and warning that detaining her would represent a “tremendous sea change.”
“I was once again fully using the First Amendment to inform people of their constitutional rights,” she claimed. “They say a lot of things, but I’ve written a formal letter, and they won’t respond.”
AOC went further, suggesting that investigating her actions could destabilize global perceptions of U.S. democracy:
“I sure hope that for all the saber-rattling that this administration is doing, that they really think about the global consequences of what it means for the United States.”
But Homan isn’t backing down, making it clear that no elected official is above the law—especially when accused of harboring and enabling illegal aliens.

View Plans“You can’t just hand out legal advice to people on how to break the law and then cry ‘First Amendment’ when you’re caught,” one senior immigration official told Fox News Digital. “If the facts bear this out, she’s going to have to answer for it.”
The case could mark a new chapter in the Trump administration’s war against sanctuary policies and unlawful shielding of illegal aliens, even when those efforts originate from within Congress itself.
