House Republican Moves to Censure Democrat McIver After Alleged ICE Assault
In a firm stand for law and order, Rep. Clay Higgins (R-La.) has introduced a resolution to censure and remove Rep. LaMonica McIver (D-N.J.) from the House Homeland Security Committee following her federal indictment for allegedly obstructing ICE agents during a chaotic incident in May.
McIver, who is facing three federal charges, including assault on federal officers, reportedly interfered in an arrest attempt by Immigration and Customs Enforcement at the Delaney Hall Immigration Facility in Newark. According to the indictment, she physically obstructed federal agents, striking one and grabbing another as she attempted to shield Newark Mayor Ras Baraka, who had unlawfully entered a secure area of the facility.
The Department of Justice stated that McIver’s interference crossed a clear line: “She wrapped her arms around the mayor, slammed her forearm into one officer, and grabbed another.” McIver has pleaded not guilty, with a trial set for November 10.
Despite the serious nature of the charges, Democrats have refused to act. Higgins’ resolution points out that House rules mandate members conduct themselves in a manner that “reflects creditably on the House,” a standard McIver's behavior clearly failed to meet.
“This is about integrity,” Higgins told Axios. “She should not be participating on the committee that has oversight and voting authority over the branch of federal government that she’s been indicted for committing crimes against.”
Republicans require indicted members to vacate all committee assignments, while Democrats only ask their members to relinquish leadership roles — a glaring double standard when it comes to accountability.
McIver responded not with humility, but with racial accusations and political deflection, calling Higgins a “bigot” and claiming the Trump administration has “weaponized” the DOJ — despite the fact that the law is being applied to her based on her own conduct, not her politics.
“This resolution aims to kick me off the committee... Good luck, Clay,” she scoffed in an Axios statement — a clear indication that Democrats believe they’re above the law when it comes to immigration enforcement.
Meanwhile, chaos surrounding ICE enforcement is spreading beyond McIver.
In New York, state Comptroller and Democrat mayoral candidate Brad Lander was temporarily arrested after allegedly assaulting an ICE agent during an attempted arrest of a suspected illegal immigrant. Lander demanded a “judicial warrant,” echoing a tired left-wing talking point that has no legal basis. As The Washington Times explained, ICE arrests are administrative, not criminal — and thus, don’t require judicial warrants.
Even Sen. Alex Padilla (D-Calif.) found himself in handcuffs — albeit briefly — during a confrontation over immigration enforcement and the National Guard’s role in Los Angeles. This pattern of Democrat lawmakers physically obstructing ICE showcases a deeper crisis: the left’s open defiance of federal immigration law.
While President Donald J. Trump works to restore law and order, Democrats are turning congressional offices into activist dens — where federal agents are treated like political enemies, and the rule of law is treated as optional.
