Pelosi Invents Imaginary Parts of Constitution in Desperate Trump Attack, Gets Schooled on Federal Law
In another display of constitutional confusion, former House Speaker Nancy Pelosi publicly cited a nonexistent section of the U.S. Constitution while blasting President Donald J. Trump for deploying National Guard troops and U.S. Marines to restore order in riot-ravaged Los Angeles.
“I hope the president would read Article 10 of the Constitution, and I urge all of you to do that, as well,” Pelosi declared about 49 seconds into her speech, surrounded by Democratic lawmakers nodding in unison. “Because section 12046 of Article 10 says that the National Guard cannot be called up by the president without the consent of the governor.”
The problem? There is no "Article 10" in the Constitution. In fact, there are only seven articles, and none of them say what Pelosi claimed. Her remarks revealed either a shocking ignorance of the founding document or a deliberate attempt to mislead the public for political gain.

What Pelosi likely meant to cite was Title 10 of the U.S. Code, not the Constitution—a distinction someone in her decades-long political career should easily understand. And even that reference was flawed.
In reality, Title 10 explicitly grants the president the authority to federalize the National Guard without needing permission from state governors. As PJ Media’s Matt Margolis explained, “The statute explicitly states that the president may call the Guard into federal service and that orders ‘shall be issued through the governors,’ which is an administrative process, and not a requirement of consent.”
He continued: “Federal law has long acknowledged the president’s right to federalize the National Guard, and the Supreme Court has affirmed the president’s right to federalize the National Guard without gubernatorial consent multiple times.”
History itself contradicts Pelosi’s spin. During the 1960s, Democrat President Lyndon B. Johnson used this same authority to federalize Alabama National Guard troops—without the governor's blessing—to protect civil rights marchers. That precedent further undercuts the Left’s latest narrative.
But Pelosi didn’t stop at one falsehood.
In the same breath, she claimed that she “begged” President Trump to send in the National Guard before the events of January 6, saying, “He would not do it… And yet, in a contra-constitutional way, he has sent the National Guard into California. Something is very wrong with this picture.”
However, the actual record tells a much different story.
Former Capitol Police Chief Steven Sund, who was directly involved on January 6, fired back on X:
“FACT: On January 6, I was restricted by Federal Law (2US1970) from bringing in ANY federal support, including the National Guard, without first receiving permission from the Capitol Police Board, which included both Sergeants at Arms who reported to Pelosi and McConnell.”
Trump himself has said repeatedly that he offered to authorize National Guard deployment days before his January 6 speech, but the request was blocked or ignored by congressional leadership.
Meanwhile, Americans are backing Trump’s decisive action in Los Angeles.
A new RMG Research poll of 1,000 registered voters, conducted Monday, found that 52% approve (either “strongly” or “somewhat”) of Trump’s decision to deploy the National Guard and Marines to Los Angeles amid escalating anti-ICE riots. Just 42% disapprove, and 7% remain undecided, according to The Daily Signal.
The lawlessness in L.A. began Friday after federal immigration enforcement operations sparked violent backlash. President Trump quickly ordered 2,000 National Guard troops to the streets, followed by another 2,000 and 700 active-duty Marines. The crackdown led to more than 100 arrests and a relative restoration of peace.
The public also strongly supports the mission of ICE agents in the city. When asked whether they “approve or disapprove of the efforts by immigration officials … to find and arrest illegal immigrants in Los Angeles,” 57% said they approve, compared to 35% who disapprove and 9% unsure.
While Democrats scramble to rewrite history and fabricate constitutional provisions, President Trump continues to demonstrate the bold leadership necessary to uphold law and order—and the American people are taking notice.
