SCOTUS Trump Immunity Ruling May Shield Barack Obama

President Donald J. Trump is escalating efforts to hold Barack Obama accountable for what he and top intelligence officials now describe as a years-long plot to undermine the will of the American people. But constitutional immunity, ironically reinforced under Trump’s own presidency by the Supreme Court, may complicate the path to prosecution.

The renewed push comes as Director of National Intelligence Tulsi Gabbard revealed a bombshell: the Obama administration allegedly manufactured intelligence to justify surveillance, sabotage, and an attempted soft coup against then-President-elect Trump after his 2016 victory.

Gabbard, appointed by Trump during his second term to lead the intelligence community, declared that she will file a formal criminal referral with both the Department of Justice and FBI.

“The evidence that we have found and have released directly point to President Obama leading the manufacturing of this intelligence assessment,” Gabbard said.

At the heart of this explosive revelation is a previously classified 2020 report declassified by Gabbard, which lays out damning conclusions from a House Intelligence Committee investigation launched by then-Chairman Devin Nunes (R-CA). The report exposes how former CIA Director John Brennan pushed discredited materials—including the infamous anti-Trump dossier—into an official Intelligence Community Assessment (ICA) meant to paint Trump as a Russian asset.

The dossier, largely based on internet hearsay and opposition research funded by the Clinton campaign, was never verified. Yet, Brennan and top intelligence brass ignored internal warnings and rushed the ICA’s release to hit the media just two weeks before Trump’s inauguration—deliberately shaping the narrative before he ever set foot in the White House.

According to the report:

  • The ICA was “ordered by the President,” directed by senior intelligence officials, and drafted by just five CIA analysts under Brennan’s oversight.
  • Analysts were pressured to publish the document before Inauguration Day, sacrificing proper vetting procedures.
  • Three of the 15 intelligence reports included were flagged internally as “substandard,” yet were deceptively presented as reliable in the final ICA.
  • The report concludes that no direct intelligence tied Putin to an effort to help Trump win the presidency—despite that being the central claim of the final assessment.

Even worse, senior CIA officials warned Brennan directly that the intelligence did not support the narrative that Russia aimed to elect Trump. Those warnings were ignored.

Appearing on Fox News, legal analyst Greg Jarrett and Rep. Jim Jordan (R-OH) weighed in on the implications. Jarrett noted that while the legal path to prosecution is fraught with obstacles—including the Supreme Court’s 2024 ruling in Trump v. United States which expanded presidential immunity—there’s still room to pursue accountability.

“Barack Obama should be thanking Donald Trump,” Jarrett quipped. “Why? Because he obtained from the U.S. Supreme Court the very kind of immunity that will protect Barack Obama.”

That decision held that a president enjoys criminal immunity for all “official acts,” raising significant questions about whether Obama’s alleged orchestration of the ICA and related actions fall within that protected scope.

Rep. Jordan didn’t mince words, calling Brennan’s misleading congressional testimony another piece of the puzzle:

“I think John Brennan misled Congress, which you’re not supposed to do,” Jordan said, referencing earlier House hearings. “I so appreciate what Tulsi has done and the work that Pam [Bondi] is now putting together to go after these guys and get to the truth.”

According to Jarrett, if elements of the ongoing cover-up extend into more recent events—like the Biden-era Mar-a-Lago raid—then the statute of limitations may reset, potentially opening legal doors that once seemed shut.

The Trump administration has made clear that the fight is far from over. With Attorney General Pam Bondi and Deputy Attorney General Todd Blanche leading the charge, the DOJ is actively pursuing new avenues to expose what they call a corrupt network of former officials who weaponized American intelligence to interfere in a lawful election.

“This wasn’t just political dirty tricks. This was a deliberate, coordinated effort to undermine the Constitution and sabotage the presidency before it even began,” one senior official told reporters Thursday.

As legal debates continue over immunity and statute limitations, one fact remains: the American people are finally seeing evidence of what many long suspected—a deliberate effort from the highest levels of the Obama administration to block Donald Trump from ever taking power.
