Stephen Miller Goes Off On Fox News Host: ‘You’re Wrong’
White House adviser Stephen Miller on Wednesday refuted Fox News anchor Bill Hemmer’s depiction of a recent Supreme Court ruling concerning a deported Maryland man, asserting that the Trump administration had actually “won” the case despite media portrayals to the contrary.
The case centers on Kilmar Abrego Garcia, a longtime U.S. resident and sheet metal worker, who was arrested in Baltimore on March 12 while picking up his five-year-old son. The arrest stemmed from prior connections to the gang MS-13, which is designated as a terrorist organization. Although Immigration and Customs Enforcement (ICE) later acknowledged in court that his deportation stemmed from an “administrative error,” the administration has refused to bring him back.
Officials continue to argue there is no binding legal requirement to return him to the U.S., especially after the Justice Department released records confirming his history with the gang. In a legal brief submitted Sunday, DOJ attorneys argued that the judiciary has no power to compel executive actions in foreign affairs, referencing the president's constitutional authority in that realm.

Appearing on America’s Newsroom on Monday, Miller responded forcefully after Hemmer summarized the case, noting that Abrego Garcia had been “mistakenly” removed. Miller quickly pushed back, accusing Hemmer of misrepresenting the facts.
“I want to correct that. I hate to do it, Bill. I have to correct you on everything you said. It was all wrong,” Miller began.
He continued, “First, we won the Supreme Court case, clearly, 9-0. A District Court judge said, unconscionably, the president and his administration have to go into El Salvador and extradite one of their citizens. That would be kidnapping. We have to kidnap an El Salvador citizen against the will of his government and fly him back to America. An unimaginable invasion of El Salvador.”
Miller said the administration appealed that decision, arguing to the Supreme Court that no District Court can mandate how the president uses his “Article II foreign powers.” According to him, the Department of Justice confirmed after the ruling that “it is amazing we won the case 9-0, we are in excellent standing here.”
Miller criticized media coverage of the decision, saying, “It has been portrayed wrong for 72 hours in the media.” He explained that “the most a court can ever compel you to do is facilitate return,” meaning that if El Salvador voluntarily sent Abrego Garcia back, U.S. officials would not prevent it. In that scenario, he’d be placed back into ICE custody and then deported again.

“The Supreme Court said that’s the most the government can be expected to do,” Miller emphasized. “So, we won the case. The misreporting on this has been atrocious.”
In defending the administration’s position, Miller also claimed that the original assertion that Abrego Garcia had been wrongly deported came from a DOJ employee who has since been terminated and who, according to Miller, was a Democrat.
“He was not mistakenly sent to El Salvador,” Miller insisted. “He was an illegal alien from El Salvador. In 2019 he was ordered deported. He has a final removal order from the United States. These are things that no one disputes. Where is he from? El Salvador. A resident and citizen of? El Salvador. Is he here illegally? Yes. Does he have a deportation order? Yes.”
Miller then accused the fired DOJ lawyer of falsely claiming the deportation was an error: “A DOJ lawyer who has been relieved of duty, a saboteur, a Democrat put into a filing, incorrectly, that this was a mistaken removal. It was not. It was the right person sent to the right place.”
Eventually, Hemmer interjected to ask whether Miller still believed Abrego Garcia was associated with MS-13, the basis for the original charge.
“Yes. But here is the thing, Bill. Yes, not only am I convinced of it, not only is El Salvador convinced of it,” Miller said, reiterating the administration’s stance before concluding, “He is an illegal alien from El Salvador with a deportation order! So, his only options in life, Bill, his only options in life, are to be deported to El Salvador or to be deported to some other country. That’s it. He has a deportation order.”
