FBI Under Biden Instructed Police to Release MS-13 Gang Member Previously Deported by Trump: Report
According to sources who spoke with Fox News, the FBI directed Tennessee law enforcement officers to release Kilmar Abrego Garcia—an MS-13 gang member deported to El Salvador by the Trump administration just last month—despite him being under suspicion for human trafficking and smuggling undocumented immigrants.
On Thursday, Jesse Watters featured a segment on his show that included footage of Abrego Garcia being questioned by police. The video reportedly shows him driving a vehicle packed with passengers. Watters noted that this is the first time the footage has aired publicly.
Abrego Garcia informed officers during the stop that he and his passengers were headed to Missouri for work and that he resided in Maryland. However, suspicions arose among the officers when they realized none of the passengers carried any luggage or personal items.
“He was a suspect in a human trafficking operation dating back three years and Fox Digital just got their hands on the body camera,” Watters said while introducing the video. “You are seeing it here first. Tennessee highway patrol stopped Kilmar for speeding and noticed he had eight other people in the car. All with no luggage.”

OFFICER: How are you?
ABREGO GARCIA: Good and you?
OFFICER: I’m all right. You have a bunch of people here, don’t you?
ABREGO GARCIA: Yes, go back to work.
OFFICER: Got you, where are you working?
ABREGO GARCIA: Missouri. Yes, sir.
OFFICER: Got you. Where do you live?
ABREGO GARCIA: Where are we living? In Maryland.
OFFICER: Whose vehicle is this? Whose car is it?
ABREGO GARCIA: My boss.
OFFICER: Where does he live? Where does your boss live?
ABREGO GARCIA: He’s in Maryland, but he lives in Texas.
OFFICER: Lives in Texas.
Following this, Watters said, “After talking to Kilmar, the officers had no doubt that he was trafficking.”
Additional footage revealed more of the officers’ concerns:
OFFICER: You know what you’ve got here right? He’s holding these people for money. A mass hauler.

OFFICER: There’s eight people in there. He’s getting paid, probably in Maryland, I would say. So let me ask you this, they don’t have any luggage in there, and if you get them out, they are going to have toothpaste and toothbrushes in their pocket, I guarantee.
OFFICER: He’s got $1400 cash in his pocket in an envelope.
“In the video, you can see one of the cops making a phone call,” Watters added. “The body camera audio cuts over 10 minutes. Sources told us that on that call was Joe Biden’s FBI, which advised police not to detain Kilmar at the time.”
Watters went on to say, “That source also tells us highway patrol called Biden’s ICE, and they never showed up. Biden’s guys had an MS-13 gangster, suspected human smuggler, and wife-beater…released into the country. God knows what he did and was never caught for before Trump deported him.”
Some Democrats have since rallied around Abrego Garcia as part of their opposition to Trump, referencing a Supreme Court order they argue mandates his return from El Salvador. However, the order merely states the administration must “facilitate” his return — language that leaves flexibility for negotiations with El Salvador’s government. As of now, those talks have not yielded results.
As more details about Abrego Garcia’s criminal history and illegal status come to light, Democratic leadership is reportedly discouraging members from making trips to El Salvador amid the growing controversy.
Asked on Monday about these visits, House Minority Leader Hakeem Jeffries avoided a direct answer and instead shifted focus to Trump’s polling numbers. Still, Democratic aides told The Bulwark that Jeffries has privately urged colleagues to hold off on traveling. “They want to let the El Salvador stuff slow down,” one senior staffer said.
